Welcome to Spoutcraft Studio! The terms "we", "us" and "our" refer to Spoutcraft Studio. Spoutcraft Studio operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). Spoutcraft Studio is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as warranty disclaimers and limitations of liability.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence, and you have given us your consent to allow any of your minor dependents to use the Services on devices you own, purchase or manage.
To use the Services, including accessing or browsing our online stores or purchasing any of the products or services we offer, you may be asked to provide certain information, such as your email address, billing, payment, and shipping information. You represent and warrant that all the information you provide in our stores is correct, current and complete and that you have all rights necessary to provide this information.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.

SECTION 2 - OUR PRODUCTS

As many of our products are handcrafted from solid copper, slight variations in appearance, finish, dimensions, texture, and patina development may occur. These variations are a natural characteristic of handmade products and should not be considered defects.

Copper is a natural material that will change colour and develop a patina over time when exposed to the elements. Product photographs are provided as a guide only, and the appearance of the product may change naturally after installation.

Certain products may be manufactured to customer-specified dimensions or requirements. Custom-made and bespoke products are produced specifically for the customer and may not be eligible for cancellation, return, or refund except in the case of a manufacturing defect or quality issue.

SECTION 3 - ORDERS

By placing an order through our website, you are making an offer to purchase the products in your order in accordance with these Terms.

After you place an order, you will receive an order confirmation by email or other electronic communication. This confirmation acknowledges that we have received your order but does not necessarily mean that your order has been accepted.

A contract between you and Spoutcraft Studio is formed when we accept your order and begin processing or dispatching the products, unless we have expressly agreed otherwise with you.

Please ensure that all measurements, specifications, and custom requirements are checked carefully before placing an order.

For bespoke and made-to-order products, production may commence shortly after an order is placed. Once production has started, cancellation requests may not be possible.

Orders for custom-made products are subject to our Returns & Refunds Policy.

All prices displayed on our website are shown in the currency indicated at checkout.

Spoutcraft Studio is not currently registered for UK VAT. We therefore do not charge UK VAT on our sales, and VAT is not included or added to the prices shown on our website.

Delivery charges, where applicable, will be shown before you complete your purchase.

For orders delivered outside the United Kingdom, including orders sent to countries within the European Union, the order may be subject to import VAT, customs duties, clearance fees or other taxes and charges imposed by the destination country.

Unless we expressly state otherwise at checkout, these charges are not included in the product price or delivery charge paid to Spoutcraft Studio.

Where import VAT, customs duties or other import charges are payable on delivery or importation, the customer is responsible for paying those charges directly to the relevant authority, customs agent or delivery carrier.

The amount of any such charges is determined by the laws and procedures of the destination country and is outside our control. Customers ordering from outside the United Kingdom are responsible for checking the applicable import requirements and charges before placing an order.

You must provide accurate and complete billing, delivery and payment information when placing an order. Payment must be made using one of the payment methods made available at checkout.

We reserve the right to refuse or cancel an order where, for example:

a product is unavailable;
we are unable to authorise or process your payment;
the information supplied with the order is incomplete or incorrect;
we reasonably suspect fraud or unauthorised activity;
we are unable to fulfil a bespoke or custom-made request; or
there has been an obvious error in the price, product description or other information displayed on our website.

We take reasonable care to ensure that prices and product information are accurate. However, errors may occasionally occur. If we discover an obvious pricing error after you have placed an order, we will contact you as soon as reasonably possible and give you the option to proceed at the correct price or cancel the order for a full refund.

If we are unable to contact you, we may cancel the affected order and refund any payment already made.

Nothing in this section affects your statutory rights.

SECTION 5 - SHIPPING AND DELIVERY

We aim to dispatch all standard size products on the next business day. As all copper products are individually inspected and hand polished prior to dispatch, occasional delays may occur during busy periods.

Custom-made and bespoke products are typically dispatched within 1–2 business days following order confirmation.

Delivery estimates:

United Kingdom: 1–2 business days after dispatch.

European Union: 3–10 business days after dispatch.

At present, we only ship within the United Kingdom and European Union. Customers located outside these regions should contact us at info@spoutcraftstudio.co.uk before placing an order to discuss available shipping options.

Shipping charges are calculated at checkout based on the destination, size, and weight of the order.

While we make every effort to ensure prompt delivery, delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by couriers, customs processing, weather conditions, or circumstances beyond our reasonable control.

SECTION 6 – INTELLECTUAL PROPERTY

All content made available through this website and our Services, including text, photographs, images, graphics, videos, audio, logos, branding, product descriptions, website design and other original content, is owned by or licensed to Spoutcraft Studio unless otherwise stated.

Such content may be protected by copyright, trade mark, design and other intellectual property rights under the laws of the United Kingdom and, where applicable, other jurisdictions. UK copyright protection is principally governed by the Copyright, Designs and Patents Act 1988.

You may access and use this website for your own personal and lawful purposes. You must not copy, reproduce, modify, distribute, republish, commercially exploit or otherwise use our content without our prior written permission, except where such use is permitted by law.

Nothing in these Terms transfers ownership of any intellectual property rights belonging to Spoutcraft Studio, Shopify or any third party.

The name Spoutcraft Studio, our logos, branding and other distinctive brand elements may not be used in a way that suggests an association, endorsement or commercial relationship with us without our prior written permission.

Shopify's name, logos and other intellectual property belong to Shopify or its licensors. Any other third-party names, logos, trade marks or content appearing on this website remain the property of their respective owners.

All rights not expressly granted under these Terms are reserved.

SECTION 7 – OPTIONAL THIRD-PARTY TOOLS

We may provide you with access to optional tools, applications or services offered by third parties. These third-party tools are not operated or controlled by Spoutcraft Studio, and we may not monitor or have control over their content, operation or availability.

Where we provide access to an optional third-party tool, this does not constitute an endorsement of that tool or its provider. Your use of any third-party tool may be subject to separate terms and conditions and privacy policies imposed by the relevant third-party provider. You should review those terms before using the tool.

To the extent permitted by law, Spoutcraft Studio is not responsible for the availability, operation, content or performance of optional third-party tools, or for loss or damage arising solely from the acts or omissions of the relevant third-party provider.

Nothing in this section excludes or limits any liability that cannot lawfully be excluded or limited, and nothing in this section affects your statutory rights.

We may introduce new features, tools or resources through the Services from time to time. Unless otherwise stated, features provided directly by Spoutcraft Studio will form part of the Services and will be subject to these Terms of Service.

Spoutcraft Studio is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Spoutcraft Studio. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Spoutcraft Studio, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Spoutcraft Studio.

SECTION 16 – WEBSITE INFORMATION AND WARRANTIES

We take reasonable care to ensure that the information provided through our Services, including product descriptions, dimensions, specifications and care information, is accurate and up to date. However, general information provided through the Services is for information purposes only and should not be relied upon as professional or technical advice.

Due to the handcrafted nature of our products, minor variations in dimensions, finish, colour, texture and appearance may occur. Copper is a natural material and may change colour and develop a patina over time. These natural characteristics and reasonable handmade variations are not, by themselves, defects.

Nothing in these Terms excludes, restricts or affects your statutory rights.

If you are a consumer, products supplied by Spoutcraft Studio must meet the requirements imposed by applicable consumer law, including requirements relating to satisfactory quality, fitness for purpose and conformity with their description.

Nothing in these Terms excludes or limits any warranty, condition, liability, right or remedy where it would be unlawful to do so.

SECTION 17 - LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL Spoutcraft Studio, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOST SAVINGS, LOSS OF DATA, REPLACEMENT COSTS, OR ANY SIMILAR DAMAGES, WHETHER BASED IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, ARISING FROM YOUR USE OF ANY OF THE SERVICES OR ANY PRODUCTS PROCURED USING THE SERVICES, OR FOR ANY OTHER CLAIM RELATED IN ANY WAY TO YOUR USE OF THE SERVICES OR ANY PRODUCT, INCLUDING, BUT NOT LIMITED TO, ANY ERRORS OR OMISSIONS IN ANY CONTENT, OR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF THE SERVICES OR ANY CONTENT (OR PRODUCT) POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES, EVEN IF ADVISED OF THEIR POSSIBILITY.
